You are welcome to email us any questions you might have regarding the final exam. In the interest of fairness, the questions will be posted here anonymously and the replies will be available for all to see.

Please check back in the coming days. The most recent questions an answers will be posted at the top.

3. I have some problems concerning finding law cases. I tried to find XX v. YY case on Westlaw which I entered through HKU library, but failed. It shows no such case exists. And this also happens to other UK cases I tried to find. Either I can’t find them or no full text avaiable. So could you kindly offer me some advice on how to find UK’s cases througn Westlaw or other online database?

For international cases, please try Westlaw International, which is linked when you sign into Westlaw HK (a small link on the upper right corner). If you have trouble finding particular cases you may wish to visit the law library for research help.

2. It was mentioned in our final class that we had two weeks and a day to complete the assignment. Yet the deadline on the website and question paper is next Wednesday. Also, whenever the deadline is, next week or the week after, might it be possible to deposit the hardcopy by 6.30, otherwise the deadline for working students will effectively be the previous evening, since getting to HKU by 5pm will be impossible for those with jobs? (Or perhaps we could email you the assignment by 5pm sharp, and deposit the hardcopy later that evening, after finishing work?)

The deadline for the final exam is Wednesday, 2 May. This is the only date that has been given on the syllabus and on the exam itself.

To accommodate working students, the deadline for submission will be extended to 6.30pm.

1. I have a question regarding the final exam paper. In Part A, Question 2, the question is how the court in the US and/or China would handle the action if the article was published in those countries. So is it Wong, the subject in the article, still a police officer in HK? Or Wong would be a police officer in those countries in question 2?

You have some flexibility on the optional Question 2.A. You may treat Wong as either a Hong Kong police officer or as an officer in the jurisdiction in question as long as you clearly state your assumption at the start of your answer.

Date: Monday, April 2, 2012
Time: 1-2 pm
Venue: Shum Wai Yau Reading Room, Eliot Hall, The University of Hong Kong (see map)
Speaker: Peggy Valcke (Research professor and Director of the Interdisciplinary Centre for Law & ICT, Catholic University of Leuven, Belgium)

TV is becoming smart, social, hybrid, connected to the internet and moving to the cloud. Internet TV and the delivery of multimedia content to the home user via the Internet are becoming increasingly common. Tthe current trend of integrating the internet and Web 2.0 features – such as social TV guides based on what your friends or people you admire are watching and recommending – into modern television sets and set-top boxes, is also unstoppable. What will be the implications of this convergence between TV and the internet for the current legal frameworks for audiovisual media? In a digital and connected media environment, where should we draw the line between ‘regulatable’ and ‘unregulatable’ content’? Which actors should be held accountable? Starting from an analysis of the Audiovisual Media Services Directive – with which the European legislator intended to provide an answer to changing business models and viewing habits in the broadcasting sector in 2007 – this presentation will examine whether notions such as “audiovisual media service”, “editorial responsibility”, “establishment”, will still be the right building blocks for TV content regulation in the future.

Peggy Valcke is research professor at the Catholic University of Leuven, where she currently heads the Interdisciplinary Centre for Law & ICT at the Faculty of Law. She is also a visiting professor at the University of Tilburg, and teaches media law at the University of Brussels and in the Florence School of Regulation. She is a leading European expert on media and communications law and was recently appointed member of the scientific committee of the newly created Centre for Media Freedom and Pluralism at the Robert Schumann Centre of the European University Institute. She is also a member of the General Chamber in the Flemish Media Regulator and of the Belgian Competition Council.
